THIS IS A BINDING LEGAL AGREEMENT (this "Agreement"). PLEASE READ THESE CAREFULLY BEFORE USING THIS SITE.
This Agreement governs your use of this site (collectively, the "Site") and is by and between Point Pleasant Lodge, owned and operated by S. P. Lodge Limited, (referred to herein as "Point Pleasant Lodge", "we", "us", "our", “property” or “hotel”) and you, on behalf of yourself and the buyer, member or supplier for which you have registered ("you"). By using, viewing, transmitting, caching, storing and/or otherwise utilizing the Site, the services or functions offered in or by the Site and/or the contents of the Site in any way, you have agreed to each and all of the terms and conditions set forth below, and waive any right to claim ambiguity or error in this Agreement. If you do not agree to each and all of these terms and conditions please do not use the Site and leave the Site immediately.

We reserve the right, at our sole and absolute discretion, to change, modify, add, or remove portions of these terms at any time without notice and, unless otherwise indicated, such changes will become effective immediately; therefore, please check these terms periodically for changes. Your continued use of the Site following the posting of changes to this Agreement will mean you accept those changes.

TERMS AND CONDITIONS:

RESERVATIONS
Reservations made ten (10) days in advance of the day of arrival are automatically guaranteed of availability until 4pm on the schedule date of arrival.

All cash and non-guaranteed reservations must be confirmed via telephone at (902) 421-1599 on the day of arrival prior to 10:00 am. to ensure availability.

All reservations are held until 4:00 p.m. unless further guaranteed by credit card. Charges will be applied to credit card at 4:00 p.m. on the day of arrival. Changes to, or cancellation of, reservations must be made, via telephone at (902) 421-1599, prior to 4:00 p.m. (16:00 hrs) Atlantic Time on the scheduled day of arrival to avoid any charges (minimum charge is one night's stay).
A credit card imprint will be required on check in. Guests wishing to pay by cash will be required to make a $100.00 refundable security deposit on check in.

In keeping with bank security policy credit cards presented for any payments/deposits must be in the name of a registered Guest.

All reservations are subject to Point Pleasant Lodge's usual terms and conditions and policies for all visitors, which are deemed accepted by the visitor when they arrive to stay at the hotel.

COPYRIGHT AND RESTRICTIONS ON USE OF MATERIALS
All material found in the pages of this web site is protected under the copyright laws of Canada, the United States and of other countries. The display of trademarks, trade names or service marks on pages at this web site does not imply that a license of any kind has been granted to anyone else.

You are free to download the material posted on this web site for non-commercial purposes, to store it temporarily on a single computer, and to print it solely for your own personal purposes.

You agree that you do not acquire any ownership rights in any downloaded content. You may not distribute copies of the material for any purpose or 'frame' it in any site you create or operate, without written consent from Point Pleasant Lodge.
You agree to abide by all copyright notices, information and restrictions contained in any content on this web site.

The information and material contained in this web site are believed to be accurate and complete at the time of their posting. Although Point Pleasant Lodge attempts to ensure that all information and material remain current and accurate, they are subject to change without notice and Point Pleasant Lodge does not warrant their accuracy, completeness and currency at all times.

In no event will Point Pleasant Lodge be liable for any damages, including without limitation, direct or indirect, special, incidental, moral or consequential damages, loss of profits, opportunities or information or for expenses arising in connection with this web site, any software algorithms available on this web site, nor with any hyperlinked web site or for the use of or the inability to use such material, software algorithms or hyperlinked web site by interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Point Pleasant Lodge is advised of the possibility of such damages, losses or expenses. Software algorithms made available and hyperlinks to other Internet resources are activated at your own risk. CONFIDENTIALITY AND PRIVACY
At Point Pleasant Lodge, protecting your privacy is very important to us. Our goal is to treat your Personal Information with the utmost respect in accordance with this Privacy Policy.

Point Pleasant Lodge reserves the right to modify or supplement this Privacy Policy statement at any time. If we make any material change to this Privacy Policy, we will notify you of the changes through this web site. However, we will seek your consent if we want to use your Personal Information for purposes other than those you have agreed to previously.

COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION
We may need the following information in order to process your requests for information: your name, e-mail address and mailing address.

If you are making a reservation, we may also require your credit card number and its expiry date, your telephone number, visit dates, and room preferences. As we are a specialty hotel serving only those directly or indirectly associated with medical attention in the Halifax/Dartmouth area, we also require information regarding such to verify your eligibility as a Guest of Point Pleasant Lodge. This information will be a) your physician/allied health care providers name and your appointment date/time, or b) the patient’s name and hospital site/room number, whichever would apply to your association with medical attention. We do not require you to divulge any other medical information including, but not limited to, medical procedures, medical specialized care units/programs (Example: MRI Scan, Transplant Program etc.), medical condition(s), diagnoses, prognoses etc. Those seeking accommodations that have no medical association, as described above, will be referred to other properties.

There are times when we may ask for, or you may choose to provide Personal Information about yourself and your business to assist us in meeting your various needs. For example, we may ask you for information about your personal preferences, which helps us develop a unique Guest Preference Profile that enables us to serve you better.

We may also collect other Personal Information when you make a reservation for, or register or use the facilities of our property. At times, we may conduct surveys to better understand the needs of our customers.

Your Personal Information may be used for the purpose of establishing and maintaining a relationship with you, providing you with services at our property, servicing your requests, improving our services, facilitating billing and collections, and developing and informing you of additional services provided by Point Pleasant Lodge.

Your Personal Information may be disclosed to third parties for the purpose of processing payment from you, including any credit card payment.

We may also aggregate statistics that we gather about our customers and provide these statistics to third parties. However, when we do, these statistics will not include Personal Information that identifies individuals.

We may also use and disclose your Personal Information if required or permitted to do so by law, including by an order of any court.

SECURITY
Security is provided concerning your credit card information, name, address, e-mail and any other Personal Information you may provide within portions of our web site. Our web site utilizes 128-bit encryption based on a Class 3 Digital Certificate issued by Comodo Group. This allows for utilization of Secure Sockets Layer, which is a method for encrypting data. This is intended to protect confidential information - such as credit card numbers, online forms, and financial data - from interception and hacking.

However, as the Internet is not a fully secure medium and therefore complete confidentiality and privacy cannot be ensured, Point Pleasant Lodge will not be liable for any damages resulting from the transmission of confidential or Personal Information to us.

Aside from website measures, we also take reasonable steps to ensure the security of personal information in our documents, including appropriate methods of storage and destruction.

CONSENT
Our collection, use or disclosure of your personal information requires your consent. Depending on the nature and sensitivity of your personal information, your consent to the collection, use and disclosure of such information may be express and positive (which may be oral, in writing or electronic) or implied (such as by using our products or services and complying with requests for information as indicated within this document) in which case we assume that you consent. Consent may be given by your authorized representative. You may refuse to provide us with personal information, and you may withdraw your consent at any time as long as you give reasonable notice of withdrawal. Note that any such refusal or withdrawal may limit our ability to serve you.

ACCESSING YOUR PERSONAL INFORMATION
You have the right to reasonable access to your personal information in our possession or control and to request rectification of any personal information that may be obsolete, incomplete or incorrect. Requests must be made by surface mail and addressed in care of the Privacy Officer (see the Contact Us section of this web site for the address). We may charge you an administration fee for providing access to your file in accordance with the nature of your request. Normally, we will respond to access or rectification requests within 30 days.

MISCELLANEOUS TERMS
By accessing this web site, you have directed your system to a server located in the province of Nova Scotia, Canada. Any disputes arising out of your use of this web site shall be governed exclusively by the laws of the province of Nova Scotia and the applicable laws of Canada. We reserve the right to change these terms and conditions at any time without notice by posting a new or revised set on this web site.

If you choose to personalize this web site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Point Pleasant Lodge reserves the right to refuse service, terminate accounts, or remove or edit content at its sole discretion.
